The hearing was called to order at 8:10 p.m.


Continuance

#1476                           Johnson, Victoria                               29 Cottage St.
Seeking two findings and a special permit relative to a proposed addition of habitable space to a structure on a non-conforming lot.  Property is situated in the Single Residence B Zone.

Sitting on Case:  John, Janis, and Richard

It was noted that the Johnson’s had hired All Seasons Septic to review the septic system and replace as necessary.  

A letter from Jim Andrews was received and read.  It noted that the septic needs to be replaced and BOH will work with applicant to come into compliance.

Vote in Favor:

Conditions:  Be in compliance with Title V regulations prior to building permit and have approved plan prior to construction.  No closet in the office.  No further increase in the non-conformity of the existing garage.

Seeking two findings and a special permit relative to proposed expansion to a structure on a non-conforming lot.  Property is situated in the Rural 2 Zone within the Surface Water District.

The applicant is adding 225 sq. feet to the house.  They are squaring off the house near the deck and putting on a new laundry/mudroom.  The existing deck will be removed.  On the 3rd floor, they will be adding a full bath.  The 2nd floor bath is being expanded.

BOH and Cons. Comm. Letter read and no objections.

Applicant described addition as a 2-story addition with the roofline to follow existing roofline.  The addition will add a 1st floor family room and a Master Bath on the 2nd floor.

Existing Sq. Footage = 1,550
Addition Footage = 822
% increase = 54%

#1458                   ERPOL Construction, LLC                 155 Mansfield Street
Applicant seeks a Comprehensive Permit under section MGL Chapter 40B to allow 12 single family homes.  Property is located on the westerly side of 155 Mansfield Street and is situated within the Rural 1 Zone and is substantially within the Wellhead Protection Area.

New Correspondence received as follows:

1/27/04 – Letter from Conservation Commision regarding project.  Letter was read.

1/27/04 – Letter from Town Engineer, Peter O’Cain, regarding grading of roadway comparison.  Just received, so insufficient time to review and respond.

Earth Tech received 8% grade document on 1/28/04, so there was insufficient time to review and comment.

Letter was submitted by David Stewart Smith dated 12/2/03.

The Timeline Archeological Review was submitted on Jan. 23, 2004.

Board inquired as to the reason why the Applicant would not accept Dr. Curtis Hoffman as a peer review.  Applicant stated that they were advised not to accept him as consultant and his response to the RFP did not fall within the time requirements outlined in the RFP.  Alan Leveill, registered Archeaologist, spoke regarding his advise to not accept Dr. Hoffman. Alan noted that he has walked over area in question.  He stated that it is unusual and questionable why Dr. Hoffman requested to not need the permit permission from the Mass. Historical Commission.  Alan also stated that he believes Dr. Martin has not collected enough data to support his theory.  He also gave an example of why he disagrees.

Dr. Martin stated that there are 9 significant rocks and they exist in a straight line; he has requested that his theory be put to the test, but he is unable to perform tests as he does not have the authority.

Dale McKinnon, Earth Tech consultant, spoke regarding sight distance.

Dan requested a continuance and to have the Traffic Engineer, Eric Hooper and Dale McKinnon present at the meeting.

Hearing continued till Wednesday, April 14 at 8:00 p.m. in Town Hall.
